Payment Terms - Revolut POS

1. What is this document?

These terms (the Revolut POS Terms) along with the Group Framework Terms, Business Terms and Business Fees page form the agreement between you and Revolut (Revolut/us/we) for the provision of the Revolut POS. The Payment Processing Services Agreement applies to the processing of any payments that you accept using the Revolut POS.


2. How does the Revolut POS work?

Revolut POS is Revolut’s point-of-sale and customer relationship management service.

You can download the Revolut POS to your supported hardware. You’ll need to download the Revolut POS App and use your existing Revolut credentials to sign in.


You can use the Revolut POS to manage orders and payments in-store, including:

  • opening tables, listing orders, parking bills, adding items, and updating the status of a table,
  • selecting items and services for purchase when a customer orders, and generating bills for customers,
  • processing payments, printing receipts, and logging customer transactions,
  • managing discounts, VAT, pricing (for in-store or takeaway consumption), and adding tips,
  • viewing sales by product, staff or time, and managing staff using the clock-in, clock-out and timesheet features,
  • receive online orders through our Order & Pay feature, and
  • any other feature we make available to you from time to time.


When customers pay:

  • by cash, you are responsible for handling the cash directly. You can use the Revolut POS to log the transaction.
  • by card, you may be able to use your Revolut POS with a Revolut Device or Tap to Pay.


Revolut POS is not regulated by any financial services regulator. Complaints will therefore not be heard by the mechanisms for financial services dispute resolution.


You are solely responsible for fulfilling your agreements with your customers for any goods or services.


You are responsible for ensuring that any QR code that you display for the Order & Pay feature is securely placed and protected. We assume no liability for incidents, such as where fraudsters replace or overlay your QR code with their own to redirect payments to a fraudulent page.

4. What customer information can Revolut POS process?


Merchants are responsible for ensuring compliance with applicable data protection laws in relation to any personal data they collect when using the Revolut POS. The Data Processing Addendum set out in the Payment Processing Terms will apply in respect of any customer personal data we process in the course of providing the Revolut POS.


5. Are there any restrictions?

Unless we expressly permit you to do so, you must not directly or indirectly (or assist or allow any other person to):

  • copy, modify, distribute, sell, sublicense, rent, loan, lease, or transfer the Revolut POS to any third party,
  • use the Revolut POS to create or facilitate the creation of any product or service that is competitive with any Revolut products or services,
  • work around any of the technical limitations of the Revolut POS or enable functionality that is disabled or prohibited,
  • reverse engineer or attempt to reverse engineer any aspect of the Revolut POS,
  • use a version of the Revolut POS that is not the most recent and up to date version of the Revolut POS,
  • perform or attempt to perform any actions that interfere with the normal operation of the Revolut POS or affect use of the Revolut POS, or
  • combine the Revolut POS with other software such that you restrict, impede, circumvent, compromise, impact the functionality of or charge for access to the Revolut POS.


You are responsible for the security of all access permissions you are provided to use the Revolut POS. You agree you will not use the Revolut POS service in conjunction with any unauthorised third party service. Authorised third party services are included in the Annex to these terms.


As between you and us, we own all rights, title, and interest, including all intellectual property rights, in and to the Revolut POS and any of its modifications or derivative works. Except for the limited rights expressly granted to you under these terms or any other agreement in force between Revolut and you, Revolut does not grant you any right, title, or interest in or to any Revolut trademarks, trade secrets, patents, brand names, copyrights, distinctive brand features, logos, domain names or any other Revolut intellectual property (“Revolut Property”). You may not use the Revolut Property without our prior written consent, including the making of any publication or communication using Revolut Property.


In order to use the Revolut POS service, we grant you a limited, revocable, royalty-free, non-transferable, non-exclusive licence to download or otherwise access and use the Revolut POS service.


You agree that you will not upload any data, images or other information to the Revolut POS service, or configure the Revolut POS service, in any way that is objectionable, illegal, immoral, constitute false information or otherwise inconsistent with Revolut’s Community Standards.


We may suspend your access to the Revolut POS if you breach these terms or any other terms that you have entered into with any company in the Revolut Group.


6. Will this agreement change?

We may add an authorised third party service to the Annex to these terms at any time without giving you notice. Otherwise, we’ll give you two months’ notice before we make any change to these terms (including the removal of an authorised third party service from the Annex). We’ll assume you’re happy with the change unless you tell us that you want to stop using Revolut POS.


You cannot change these terms.


7. Providing feedback

If you provide us any feedback in relation to the Revolut POS service, you agree that we may use such feedback at our discretion without attribution or compensation to you. You agree we may collect performance metrics and use the data that you provide through your use of the Revolut POS service to improve the service and to offer other products and services to our customers.


8. How do I end the Revolut POS service?

If you want to end your use of the Revolut POS service, you can contact us by using the chat function located under the Help section of our App.


We bill you each calendar month and will cancel your service from the start of the next month as long as you contact us at least two working days before the end of the month. For example, if you contact us to cancel your service on Tuesday 29 August, we will cancel your service from the end of August; if you contact us to cancel on Wednesday 30 August, we will cancel your service from the end of September.

Governing law

The laws of England and Wales apply to this agreement.

Disputes

If you want to take legal action against us in the courts, only the courts of England and Wales can deal with any dispute between you and us.

Entire agreement

These Terms, together with the Group Framework terms, Business Terms and Business Fees Page and any other terms and conditions incorporated in these documents by reference constitute the entire agreement between you and Revolut in relation to Revolut POS. For the avoidance of doubt, FAQs do not form part of our agreement with you.

Our right to transfer

We may transfer and/or assign our rights and/or obligations under this agreement if we reasonably believe that this won’t have a significant effect on your rights under this agreement or if we’re required to do so under law. You cannot do this.

Our right to enforce these terms

If you have broken any terms of this agreement and we don’t exercise our rights immediately, we reserve the right to exercise our rights at a later date.

These terms are severable

If something in these terms is held to be unlawful, the rest of these terms will still apply.

Third parties do not have rights

Third parties do not have rights under these terms under the Contracts (Rights of Third Parties) Act 1999.

The following provisions of the Personal Terms will continue in force on or after the termination or closure of your account and shall remain in full force and effect:
